This paper tests Harry Arthur's theory that there is an “ethical economy“ of lawyer regulation in Canada, in which Canadian law societies use their regulatory powers only in high reward/low risk cases - ie, where the practitioner is less likely to resist their authority and the offence is morally unambiguous. Analysing reported cases from 2009 in British Columbia, Alberta, Saskatchewan, Manitoba and Nova Scotia the paper concludes that Arthurs' description still accurately characterises the regulation of lawyers by Canadian law societies. The paper then conducts a case study of law society and court cases related to one Canadian lawyer, Anthony Merchant, to assess whether the ethical economy is inevitable, or whether a different approach to lawyer regulation can and should be undertaken. In the dialogues for which we gathered, we followed a process of learning inspired by chavruse, the method of Torah and Talmudic study found in (...) yeshivas, in which one reads a text with friends, in order to see and understand in ways that would be impossible for individuals alone. The mutually constitutive project of Womanist-Buddhist engagement with Buddhist texts has helped to shift the boundaries within Womanist religious thought and Buddhist studies. We are grateful for the trust—essential to any healthy dialogue—embodied in our work together, and for the deep humility and honor that has been shown by all who are engaged in the process.The Buddhist "self": A Womanist PerspectiveIn a conversation with a friend recently, I was encouraged to hold on to the humanness that suffering teaches by being fully present with a broken heart. My grief was offered tea, and I was invited to join in the depths of suffering for a "spell," sharing stories of strength and longing, through a process of healing meditation. I hear this invitation echoed in essays by Alice Walker in We Are the Ones We've Been Waiting For: Inner Light in a Time of Darkness, as well as in the work of Jan Willis. Both scholars are committed to telling the truths in women's stories and uncovering the "true self" through spiritual means. Here, I present some reflections on how engaging Buddhist texts as a Womanist scholar opens up a new perspective on the Womanist theme of self-love and how this can shift our understanding of the Buddhist self.The "Buddhist self," you say? Although Buddhism insists there is "no self"? Yes! The concept of no-self in Buddhism is often equated with "dissolving" the self; I would argue that Buddhist contemplative practices can be seen and experienced as form of healthy self-love and self-care, necessary to sustain activists' work for compassionate justice. According to Walker's definition, a Womanist "Loves herself. Regardless."1 To consider Buddhist meditation as a strategy of self-love and social justice [End Page 67] helps us to see why so many African American women are turning toward Buddhism as a religious orientation.Buddhist meditation invites one to overcome oppression and transform the self and the community, by raising consciousness through a true turning or shifting of mind, in a manner that produces clarity of thought and inner peace. As the Buddhist nun Pema Chödrön has observed, most people who are not raised Buddhist come to Buddhism because they are suffering and trying desperately to get out of dukkha. However, when confronted with the First Noble Truth that suffering is just part of life, many people turn away from meditation, pack up their sitting mats, and return home to habitual patterns.Sitting still on the mat for a long time, for any length of time really, seems to most beginners like an otherworldly commitment—unless of course, one has reason to stay, reason to change. As Willis has observed, most people of African descent do have reason.2 She says Buddhism offers at least three major gifts to African Americans—I would add Womanists here—and to all people of color who have experienced historical traumas such as slavery, exploitation, and cultural genocide. They are: (1) confidence in our humanity—a special gift to a people who have endured four hundred years of slavery and oppression, in which the very essence of our humanity was consistently ravaged; (2) a way of being in the world that emphasizes self-love and inner and communal wholeness; and (3) a method for dealing with the frustrations, disappointments, and anger left behind by multilayered oppressions. Rather than negating the self, and everyone else around, by succumbing to practices of patriarchy, or by falling into the traps of internalized oppression, or by pulling out our hair after upsetting meetings, or by indulging... My argument is that faced with such reversal of stereotypical female roles, the culture relies on both the institution of the law and the custom of storytelling to reassure itself about boundary confusions—between guilt and innocence, man and woman, seductress and seducer, fact and fiction. The Thaw trial, however, shows that the law itself could not resolve any of those ambiguities, a predicament which, I will argue, Twain entertains and creates in his own fictional courtroom but flees from in his (...) response to the actual trial.My argument thus depends upon establishing particular dialogue between these two cases of seduction, for neither Twain’s nor the journalistic accounts alone tell the story that the two together do. Both cases speak in common to two aspects of fictionality. One is a mode of social differentiation, the sexual and legal categories essential to both cases, but whose actual application was, for different reasons in each, momentarily suspended. It was impossible to decide, for example, whether Evelyn Thaw or Alice or Twain himself, for that matter, should be classified as victim or victimizer, as playing the active or passive role in their respective narratives. The temporary suspension of these categories, I will argue, does not invalidate them or brand them as “fictive,” but rather reveals them as culturally constructed and culturally applied, in Twain’s words “fictions of law and custom” . In both cases, the response to this moment when cultural categories cannot be definitively applied is a process of storytelling—a second aspect of fictionality—that attempts to construct coherent narratives about those suspended “fictions of law and custom.” Although Twain’s “Alice” case opens in 1877, not until it connects with the Thaw trial in 1907 does the full story, as I have just briefly outlined it, emerge. It is precisely that double story that this esay will tell: the story of how Twain’s personal compulsions met up with his culture’s in the act of reporting, representing, interpreting, and finally making its own events mean. To commemorate the book's forthieth anniversary, David Cannadine has gathered an all-star cast of contributors to ask and seek answers to E.H. This introductory article to the thematic section on “Spiritual Intelligence” sets out the ways in which spiritual intelligence is currently conceptualized. Most prominently, spiritual intelligence is understood as an adaptive intelligence which enables people to develop their values, vision, and capacity for meaning. Questions arise as to whether spiritual intelligence is a distinct form of intelligence, and how to frame it if it is. It is questionable whether psychometric approaches justify concluding there is a distinct spiritual intelligence, and the authors (...) reject any notion of a God spot in the brain specifically dedicated to spiritual intelligence, which is a much more broadly embodied phenomenon. The authors suggest that spiritual intelligence most likely makes use of existing cognitive architecture, though applied in a distinctive way. This article finishes with a brief introduction to the four main articles in this thematic section, which present spiritual intelligence as a kind of participation in transcendent being. The four articles approach the cognitive, embodied, meditative, and ritual aspects of spiritual intelligence as participation. (shrink)

This article explores three aspects of Masterman's language work and applies them to questions of spiritual intelligence: metaphor, coherence, and ambiguity. First, metaphor, which is ubiquitous in ordinary language, both leads and misleads in religious and scientific understanding. Masterman's case for a “dual-approach” to thinking, both speculative and critical, is explored and tied to concepts of moral-spiritual development per Pierre Hadot and Hannah Arendt. Second, Masterman's work on machine translation presents semantic disambiguation as an emerging coherence wherein one gradually hones (...) in on meaning through features of ordinary language (like redundancy and repetition). This is applied to the problem of comprehending difficult spiritual language, and tied to spiritual stretching and spiritual cartography. Third, Masterman's work with thesauri, rather than relying on words as having fixed meanings, appeals to a concept of semantic spaces, nebulae of variously interconnected meanings. This is constructed into an exhortation to reambiguate overfamiliar religious language, to reinvest one's quotidian surroundings with spiritual meaning through defamilarization. (shrink)

There is a popular and widely accepted version of the precautionary principle which may be expressed thus: “If you are in a hole—stop digging!”. Tom Baldwin, as Deputy Chair of the Human Fertilisation and Embryology Authority , may be excused for rushing to the defence of the indefensible,1 the HFEA’s sex selection report,2 but not surely for recklessly abandoning so prudent a principle. Baldwin has many complaints about my misrepresenting the HFEA and about my supposed elitist contempt for public opinion; (...) readers of this exchange will decide for themselves.REDRAFTING THE REPORTBaldwin begins with a piece of wishful thinking:"Harris objects that in this recommendation “an absurdly high standard of caution is employed”, since a theoretical risk is associated with almost all medical procedures. This objection is misplaced: as paragraph 142 of the report indicates, the phrase “theoretical risk” is to be understood here in the light of the earlier discussion of the risks arising from the fact that flow cytometry exposes sperm to laser energy, a procedure which is known to be liable to damage DNA."Paragraph 142 does not make that clear. It does indeed refer back to a set of earlier paragraphs but these give, if anything, an upbeat assessment of the safety of flow cytometry. Paragraph 121 states: “However whilst potentially less intrusive, and with potentially lower risk to the health of patients, flow cytometry …” .2 But even if the overall burden of the report does indicate unresolved fears, the standard is still absurdly high. However, so far from endorsing the report’s judgement that flow cytometry has “potentially lower risk to the health of patients”, Baldwin now regards the risk of flow cytometry as “serious”1:"Since the application of flow cytometry to humans is a new procedure, the risk of … ". An argument that moral functioning is immeasurably complex, mediated by biology but not determined by it. Throughout history, humanity has been seen as being in need of improvement, most pressingly in need of moral improvement. Today, in what has been called the beginnings of “the golden age of neuroscience,” laboratory findings claim to offer insights into how the brain “does” morality, even suggesting that it is possible to make people more moral by manipulating their biology. Can “moral bioenhancement”—using technological or (...) pharmaceutical means to boost the morally desirable and remove the morally problematic—bring about a morally improved humanity? In The Myth of the Moral Brain, Harris Wiseman argues that moral functioning is immeasurably complex, mediated by biology but not determined by it. Morality cannot be engineered; there is no such thing as a “moral brain.” Wiseman takes a distinctively interdisciplinary approach, drawing on insights from philosophy, biology, theology, and clinical psychology. He considers philosophical rationales for moral enhancement, and the practical realities they come up against; recent empirical work, including studies of the cognitive and behavioral effects of oxytocin, serotonin, and dopamine; and traditional moral education, in particular the influence of religious thought, belief, and practice. Arguing that morality involves many interacting elements, Wiseman proposes an integrated bio-psycho-social approach to the consideration of moral enhancement. Such an approach would show that, by virtue of their sheer numbers, social and environmental factors are more important in shaping moral functioning than the neurobiological factors with which they are interwoven. Deepfakes pose a multi-faceted threat to the acquisition of knowledge. It is widely hoped that technological solutions—in the form of artificially intelligent systems for detecting deepfakes—will help to address this threat. I argue that the prospects for purely technological solutions to the problem of deepfakes are dim. Especially given the evolving nature of the threat, technological solutions cannot be expected to prevent deception at the hands of deepfakes, or to preserve the authority of video footage. Moreover, the success of such (...) technologies depends on institutional trust that is in short supply. Finally, outsourcing the discrimination between the real and the fake to automated, largely opaque systems runs the risk of undermining epistemic autonomy. (shrink)

The neonatal nurse forges a unique partnership with parents of a critically ill infant who are often, unexpectedly, exposed to the bewildering and complex environment that is neonatal intensive care, helping navigate them through this unchartered territory. Our role is multifaceted, with the primary focus of providing care in the best interests of our patients.1 This is realised through the provision of high-quality evidence-based care, advocating for the needs of the baby and family, and when required acting as a linchpin (...) bridging communication channels between medical and nursing teams, other allied health professionals, and the family.1 2 Ordinarily, the birth of an extremely preterm infant is a distressing, life-changing event for parents; this is further complicated by a number of additional factors in this complex scenario3. People have a powerful interest in geneticprivacy and its associated claim to ignorance,and some equally powerful desires to beshielded from disturbing information are oftenvoiced. We argue, however, that there is nosuch thing as a right to remain in ignorance,where a right is understood as an entitlementthat trumps competing claims. This doesnot of course mean that information must alwaysbe forced upon unwilling recipients, only thatthere is no prima facie entitlement to beprotected from true or honest information aboutoneself. Any claims to be (...) shielded frominformation about the self must compete onequal terms with claims based in the rights andinterests of others. In balancing the weightand importance of rival considerations aboutgiving or withholding information, if rightsclaims have any place, rights are more likelyto be defensible on the side of honestcommunication of information rather than indefence of ignorance. The right to free speechand the right to decline to acceptresponsibility to take decisions for othersimposed by those others seem to us moreplausible candidates for fully fledged rightsin this field than any purported right toignorance. Finally, and most importantly, ifthe right to autonomy is invoked, a properunderstanding of the distinction between claimsto liberty and claims to autonomy show that theprinciple of autonomy, as it is understood incontemporary social ethics and English law,supports the giving rather than the withholdingof information in most circumstances. Selective serotonin reuptake inhibitors (SSRIs) have gained a degree of prominence across recent moral enhancement literature as a possible intervention for dealing with antisocial and aggressive impulses. This is due to serotonin's purported capacity to modulate persons’ averseness to harm. The aim of this article is to argue that the use of SSRIs is not something worth getting particularly excited about as a practicable intervention for moral enhancement purposes, and that the generally uncritical enthusiasm over serotonin's potential as a moral (...) enhancer is a consequence of the paucity of viable options for envisaging practicable moral enhancement interventions. While there are many conceptual issues raised by the idea of moral enhancement generally, and by the idea of serotonin as a morally affective agent, the aim here is to look at practical concerns. It is argued that SSRIs do not, nor cannot in the reasonably foreseeable future, be made to work as a reliably safe or reliably effective means for moral enhancement, even within the very limited remit of treating “reactive” aggression. SSRIs might be effective as a limited and partial mental health intervention (even this is questionable), but not as a generally effective moral enhancement technology. (shrink)

This study examines the contentious claim that much evangelicalism is fundamentalist in character. Within Protestantism, the term `fundamentalism' denotes not only a movement but also a mentality which has greatly affected evangelicals, and which involves preserving as factual a reading of scripture as possible. Here the development and dismantling of the fundamentalist mentality is examined in light of philosophical influences upon evangelicalism over the last three centuries, notably: Common Sense Realism, neo-Calvinism, and modern hermeneutical philosophy. Particular attention is paid to (...) James Barr's critique of fundamentalism and to evangelical rejoinders. Harriet A. Harris proposes that the fundamentalist mentality does not do justice to evangelical experience since it is more concerned with the Bible's factual truthfulness than with its life-giving effects. An appendix on Global Fundamentalism brings together two rarely united fields of study: Protestant fundamentalism's relation to evangelicalism, and its relation to resurgent movements in other religions. The panic occasioned by the birth of Dolly sent international and national bodies and their representatives scurrying for principles with which to allay imagined public anxiety. It is instructive to note that principles are things of which such people and bodies so often seem to be bereft. The search for appropriate principles turned out to be difficult since so many aspects of the Dolly case were unprecedented. In the end, some fascinating examples of more or less plausible candidates for the (...) status of moral principles were identified; central to many of them is the idea of human dignity and how it might be affected by human mitotic reproduction. Science and Homosexualities is the first anthology by historians of science to examine European and American scientific research on sexual orientation since the coining of the word "homosexual" almost 150 years ago. This collection is particularly timely given the enormous scientific and popular interest in biological studies of homosexuality, and the importance given such studies in current legal, legislative and cultural debates concerning gay civil rights. However, scientific and popular literature discussing the biology of sexual orientation have been short-sighted in (...) representing it as objective, new scientific work. This volume demonstrates that the quest for the biological "cause" of homosexuality and other sexualities is as old as the term itself. These essays explore the active role experimental subjects played in shaping scientific theories of homosexuality and cultural perceptions of sexuality and sexual identity. Finally this anthology studies the way in which this doctor-patient interaction shaped not only scientific theories of homosexuality, but also cultural perceptions and self-identities as well. This paper argues that the HFEA’s recent report on sex selection abdicates its responsibility to give its own authentic advice on the matters within its remit, that it accepts arguments and conclusions that are implausible on the face of it and where they depend on empirical claims, produces no empirical evidence whatsoever, but relies on reckless speculation as to what the “facts” are likely to be. Finally, having committed itself to what I call the “democratic presumption”, that human freedom will (...) not be constrained unless very good and powerful reasons can be produced to justify such infringement of liberty, the HFEA simply reformulates the democratic presumption as saying the opposite—namely that freedom may only be exercised if powerful justifications are produced for any exercise of liberty. ObjectiveTo present (1) the ethical concepts related to the debate on resuscitation of extremely premature infants (EPIs) as they are described in the ethical literature; and (2) the ethical arguments based on these concepts.DesignWe conducted a systematic review of the ethical literature. We selected articles based on the following predefined inclusion/exclusion criteria: (1) English language articles (2) presenting fully elaborated ethical arguments (3) on resuscitation (4) of EPIs, that is, infants born before 28 weeks of gestation.AnalysisAfter repeated reading of articles, (...) we developed individual summaries, conceptual schemes and an overall conceptual scheme. Ethical arguments and concepts were identified and analysed.ResultsForty articles were included out of 4709 screened. Personhood, best interest, autonomy and justice were concepts grounding the various arguments. Regarding these concepts, included authors agreed that the best interest principle should guide resuscitation decisions, whereas justice seemed the least important concept. The arguments addressed two questions: Should we resuscitate EPIs? Who should decide? Included authors agreed that not all EPIs should be resuscitated but disagreed on what criteria should ground this decision. Overall, included authors agreed that both parents and physicians should contribute to the decision.ConclusionsThe included publications suggest that while the best interest is the main concept guiding resuscitation decisions, justice is the least important. The included authors also agree that both parents and physicians should be actively involved in resuscitation decisions for EPIs. However, our results suggest that parents’ decision should be over-ridden when in contrast with the EPI’s best interest. (shrink)

This article explores the overlap between systems biology and predictive neuroscience, placing them in their larger context, the contemporary trend of bioinformatic convergence across the sciences. These two domains overlap with respect to their interest in data accumulation and data integration; their reliance on computational statistical correlation; and their translational goals, that is, producing practical fruits and applications from the interscientific cross-pollination that contemporary data-integrative approaches make possible. The interventions that such translational conversations generate are medical and social in nature, (...) and are aimed at both prevention and treatment. It will be argued that such approaches, socially and medically applied, contain potential for conveying both agency-enhancing and agency-diminishing social messages. The article concludes with a call to balance the overwhelmingly quantitative focus characteristic of predictive neuroscience with more qualitative empirical methodologies. Du Bois regarded social reform as a legitimate object for the scientist. He gave a place to non-epistemic values in scientific reasoning and, to counter the effects of scientific racism, he constructed his approach around the belief that scientists must adopt an assumption or scientific hypothesis that African Americans are human. His engagement in scientific research was a way to reform the society in which he lived, which in turn, led him to defend the faithfulness to fact as his conception (...) of scientific objectivity. This essay examines his sophisticated theory of facts, account of the difference between the natural and human sciences, and unique pragmatist theory of truth. (shrink)

: The concept of the person has come to be intimately connected with questions about the value of life. It is applied to those sorts of beings who have some special value or moral importance and where we need to prioritize the needs or claims of different sorts of individuals. "Person" is a concept designating individuals like us in some important respects, but possibly including individuals who are very unlike us in other respects.
